Andy Dick has been sued by a Dallas man, who claims the comedian rubbed his genitals against the left side of his face during a performance in the Texas city.
The performance went down Dec. 19, 2010 at Trees nightclub. But the suit, filed by Robert Tucker, was just presented this morning
According to TMZ the suit says “Tucker claims Andy approached him in the crowd and “pulled down his costume skirt with his right hand, exposing the fact the he was not wearing underwear beneath the skirt.” And that’s when the rubbing took place.
In the report, Tucker says he felt “degraded and humiliated” by Dick and says he’s even been “harassed and ridiculed by the workers he supervises as well as his management peers.”
Tucker is suing for unspecified damages.
You can watch Dick’s performance in question below. The alleged genital rubbing happens at about the 3:30 mark.
This suit comes on the heels of Dick’s performance in late April at Portland, OR’s Bridgetown Comedy Festival, where we observed the comic onstage as one of his characters, Daphne Aguilera– the fictitious sister of Christina Aguilera. Our reporter Meagan Kate had this to say:
A few minutes into the show, the makeshift skirt he had been wearing started to fall and I heard mumbles of prayers and shock in the theater. Dick was nude from the waist down – with nothing but a blonde wig and a tiny corset on. His member was taped back – so something tells me this was in the plan all along, but was simply executed incorrectly.
After his performance, Dick went missing for days in Portland before turning up safe and sound in Los Angeles, where he lives.
As you probably know, this Dallas incident is not the Dick’s first brush with trouble. In early May, the admitted drug addict and alcoholic — his Twitter bio reads “sometimes sober. sometimes not. get off my back already!” — was arrested at a restaurant in Temecula, CA for acting disorderly and being under the influence.
In January 2010, Dick was arrested with two felony counts of sexual abuse in West Virginia after groping a bar patron and the venue’s bouncer.
He was kicked out of a winery in Temecula, CA in April of 2010 for being too drunk and for acting disorderly.
In September of 2008 he was charged with sexual assault after allegedly pulling down a 17-year-old girl’s shirt outside a restaurant in Murrieta, CA. A judge on the case eventually ruled that it wasn’t a sexual assault and Dick was ultimately arraigned for battery, public intoxication, possession of marijuana and unlawful possession of a controlled substance.
In the end, Dick was ordered to wear an alcohol monitor on his ankle for one year.
In March of 2009, the web series House Arrest with Andy Dick premiered on Atom.com. Despite the show’s title, Dick wasn’t really on house arrest.
